The following is a legal agreement between 'You' the customer, and 'BEEPstock/Robin Beckham' the photographer. By purchasing a Digital Image from this website, you agree to be bound by the terms of this agreement automatically, without any other conditions or declarations. If you do not agree with these terms, You are not permitted to purchase any digital image from this website.
All Images on the Website are copyrighted and they are the properties of BEEPstock/Robin Beckham. All rights are reserved unless otherwise granted to you. Your rights to use the image/s are subject to this agreement.
Usage Restrictions
PERMITTED USES
Upon receipt of payment, you may use your purchased image\s only for the purpose which you specified while placing the order which has been agreed with the photographer. Any additional usage requirements must be arranged with the photographer immediately, and will be subject to a new fee being calculated for the new or additional use.
PROHIBITED USES
You may NOT use any purchased image in the following ways, unless they are expressly permitted by BEEPstock/Robin Beckham in writing prior to it's use: In electronic items for resale, such as website templates, document templates, wallpapers, screen savers, e-cards or similar products that you intend to sell or distribute. For creating printed reproductions that You intend to sell. On physical items for resale and "print on demand" items such as t-shirts, postcards, mouse pads, coffee mugs, calendars (e.g. on sites like Cafepress, or photobox), or on any similar mass produced items that would contain the Image in a dominant way. For pornographic, unlawful or other immoral purposes, for spreading hate or discrimination, or to defame or victimise other people, societies and/or cultures. In a way that would make people assume that the person(s) depicted on the Image is/are endorsing a certain product or a service. In a way that could give a bad name to either the photographer / BEEPstock/Robin Beckham or the person(s) depicted in the Image, including illustrating sensitive social subjects such as health issues, crime, sexual preferences, drug abuse or similar issues. As part of a business name, trademark, service mark or logo.
Selling and redistribution of the image (Individually of along with any other images) is strictly forbidden.
Your Rights
You acknowledge that by purchasing an Image\s the ownership of the image does not get transferred to You, the customer, and You must not claim that it is yours. Your license is non-transferable, which means that You, the customer, are not allowed to sell, rent, give, sub license, or otherwise transfer the image or the right to use the image to anyone else.
Indemnification
You agree to indemnify, defend, and hold harmless BEEPstock/Robin Beckham, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this agreement, the use of this site and the use or the inability of use of any Image, your failure to abide by any restriction regarding the use of an Image/s, or any claim by a third party related to the use of an image/s.
Model Release and Property Release
A model release or property release is a written agreement between the model or property owner and the photographer granting the photographer permission to use the photographs commercially. Releases generally permit the use of the image(s) for all purposes, with exceptions for controversial, sensitive or defamatory uses. However, it is your responsibility to decide if a model and/or a property release is necessary and appropriate for your intended image use Images without model release and property release should only be used for editorial purposes. It is 'You' the customer who must satisfy himself/herself that all necessary rights, releases or consents which may be required for reproduction, are obtained, and it is acknowledged that BEEPstock/Robin Beckham gives no warranty or undertaking that any such rights, releases or consents are or will be obtained whether in relation to the use of names, people, trade marks, registered or copyright designs or works of art depicted in any picture, no image should be used for controversial, sensitive or defamatory unless by prior agreement. In the event that the picture is used or reproduced by or with the authority of the Client then the Client shall indemnify BEEPstock/Robin Beckham against any loss, damage, proceedings or costs where such rights, releases or consents have not been obtained.
Sensitive Issues: A model may have signed a model release but may not consent to their image being used for a sensitive issue subject, A list of sensitive issue subjects are shown here for illustrative purposes only, but should not be considered full or definitive: Abortion and/or pro-life or pro-choice, Sexual and sexual health issues, Gambling, Violent acts, Criminal acts, Guns and weapons, Medical and mental health, Negative financial portrayal, Political or Religious fanaticism, Alcohol, Tobacco issues, Drugs or other addictive issues.
Credit
Any published image/s MUST clearly display the photo tag line 'Photo: BEEPstock/Robin Beckham' alongside each image. There is no exception to this policy unless otherwise agreed in writing with the photographer prior to the image/s being published.
Refund policy
Refunds will be given at the discretion of BEEPstock.com/Robin Beckham Images Limited
Warranty
BEEPstock/Robin Beckham warrants that the digital copy of the image/s provided to you will be free from defects in material and workmanship (not visual artefacts inherent in original image) for thirty (30) days following delivery from this site.
BEEPstock/Robin Beckham will, as your sole and exclusive remedy for your inability to use an image and at its sole discretion, provide you with a replacement of the digital copy of such image, or refund any fee paid by you to BEEPstock/Robin Beckham, provided you have not made any licensed use of the image. BEEPstock/Robin Beckham makes no warranties nor shall be liable for any image which: (1) has been modified by you (2) has been combined by you with other images, products, content or materials (3)BEEPstock/Robin Beckham has previously notified you not to license or otherwise use.
Except as provided above, BEEPstock/Robin Beckham makes no warranties (express or implied) with respect to images. BEEPstock/Robin Beckham does not warrant that caption information is accurate. BEEPstock/Robin Beckham makes no other warranty regarding any image/s, or any rights or licenses under this agreement including, without limitation, that the images are error free.
While BEEPstock/Robin Beckham takes all reasonable care in the performance of this Agreement generally, BEEPstock/Robin Beckham shall not be liable for any loss or damage suffered by the You or the Client or by any third party arising from technical faults with digital image/s, failure to download the purchased digital image/s, use or reproduction of any picture or its caption.
